Welcome to vibecoder.date ("Service", "we", "us", "our"). By using our Service, you agree to these Terms of Service ("Terms"). If you don't agree, don't use the Service.

1. Eligibility

  • You must be at least 18 years old to use this Service. By creating an account, you confirm you are 18 or older.
  • We reserve the right to request proof of age at any time and to terminate accounts that violate this requirement.
  • You must provide accurate information during registration.

2. Account & Security

  • You are responsible for maintaining the security of your account credentials.
  • You are responsible for all activity that occurs under your account.
  • You must notify us immediately of any unauthorized access.
  • One account per person. No bots, fake accounts, or impersonation.

3. Acceptable Use

You agree NOT to:

  • Harass, abuse, stalk, threaten, or intimidate other users
  • Post illegal, harmful, or explicit content (including nudity, violence, hate speech)
  • Discriminate against others based on race, ethnicity, religion, gender, sexual orientation, disability, or any protected characteristic
  • Use the Service for commercial purposes, advertising, or spam
  • Scrape, crawl, or harvest user data
  • Attempt to circumvent security measures or access others' accounts
  • Use automated tools or bots to interact with the Service
  • Misrepresent your identity or create fake profiles
  • Share others' personal information without consent
  • Use the Service while under the influence in a way that impairs judgment
  • Solicit money from other users

We reserve the right to suspend or terminate accounts that violate these rules, at our sole discretion, without notice or refund.

4. Content & Conduct

Your Content

  • You retain ownership of content you post (photos, bio, messages).
  • By posting content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content within the Service.
  • You represent that you have the right to post any content you upload.

Content Moderation

  • We use automated systems to detect prohibited content (nudity, explicit material, etc.).
  • We may remove content that violates these Terms without notice.
  • We may report illegal content to law enforcement.

No Tolerance for Objectionable Content

We have zero tolerance for:

  • Child sexual abuse material (CSAM) - reported to NCMEC immediately
  • Non-consensual intimate images
  • Content promoting violence or terrorism
  • Content promoting self-harm or suicide

5. User Interactions

No Guarantee of Safety

  • We do not conduct background checks on users.
  • We do not verify the identity, intentions, or truthfulness of users.
  • You interact with other users at your own risk.
  • We strongly recommend meeting in public places and informing someone of your plans.

We Are Not Responsible For

  • The behavior of any user, online or offline
  • Any damages arising from interactions with other users
  • The accuracy of information in user profiles
  • Any physical, emotional, or financial harm resulting from use of the Service

Report Abuse

  • Use the in-app reporting feature to report abusive users.
  • We investigate reports but cannot guarantee outcomes.
  • Reporting a user automatically blocks them from your account.

6. Payments

One-Time Purchases

  • We offer optional one-time purchases (Boosts, AI Pickup Lines).
  • All payments are processed through NOWPayments (cryptocurrency).
  • All payments are final and non-refundable.

No Subscriptions

  • We do not offer subscriptions.
  • We do not store your payment information.

Cryptocurrency

  • Payments are made in cryptocurrency.
  • We are not responsible for transaction fees, network delays, or price fluctuations.
  • Once a transaction is confirmed on the blockchain, it cannot be reversed.

7. Privacy & Encryption

End-to-End Encryption

  • Messages between matched users are end-to-end encrypted.
  • We cannot read your messages. We do not have access to encryption keys.
  • This means we cannot moderate message content or recover lost messages.

Data We Collect

Data We Don't Collect

  • We do not store payment transaction details (handled by NOWPayments).
  • We do not have access to encrypted message content.

8. Intellectual Property

  • The Service, including its design, code, and branding, is owned by us.
  • You may not copy, modify, or distribute any part of the Service without permission.
  • "vibecoder.date" and associated logos are our trademarks.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

WE DISCLAIM ALL WARRANTIES, INCLUDING:

  • MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT
  • ACCURACY OF CONTENT
  • UNINTERRUPTED OR ERROR-FREE SERVICE

WE DO NOT GUARANTEE:

  • That you will find a match
  • That any user is who they claim to be
  • That the Service will meet your expectations
  • That the Service will be available at all times

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
  • WE ARE NOT LIABLE FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL.
  • WE ARE NOT LIABLE FOR ANY DAMAGES ARISING FROM USER INTERACTIONS.
  • OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS, OR $100, WHICHEVER IS LESS.

11. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Your content or conduct

12. Termination

By You

  • You may delete your account at any time through the app settings.
  • Deletion removes your profile and personal data.
  • Encrypted messages remain encrypted (unreadable without keys).

By Us

  • We may suspend or terminate your account at any time, for any reason, without notice.
  • We may terminate the Service entirely at any time.
  • No refunds will be provided for terminated accounts.

13. Dispute Resolution

Informal Resolution

  • Before filing a claim, you agree to contact us and attempt to resolve the dispute informally.

Arbitration

  • Any disputes will be resolved through binding arbitration, not in court.
  • Arbitration will be conducted individually, not as a class action.
  • You waive your right to a jury trial.

Exceptions

  • Either party may seek injunctive relief in court for intellectual property violations.
  • Small claims court is available for qualifying disputes.

Governing Law

  • These Terms are governed by applicable law.
  • This Service is intended for users in the United States. We make no claims that the Service is appropriate or available outside the US.

14. Changes to Terms

  • We may modify these Terms at any time.
  • Changes are effective when posted.
  • Continued use of the Service after changes constitutes acceptance.
  • We will notify users of material changes via email or in-app notification.
